Kinda hypocritical of CB employees to cry about recasters while at the same they so blatantly break copyright laws themselves. Just because they've slipped past the cracks for now, doesn't mean they should continue to do so.
Recasting is a different issue, though. First, it's literally stealing money from CB, denying CB those sales of new product. Second, the models are worse quality, which further damages CB's reputation for QA. Swiping someone else's characters and putting them into your game is a different part of copyright law.
Even so, I agree that it's kinda hypocritical from CB. If tomorrow I make my own miniature heavily inspired on, for example, Bran Do Castro, will they sue? What if I do so based on Aristeia! models? What if I "copy" most of their range, but in the process of suing me they call the attention of the ones they have copied, like DC or Marvel? Nobody messes with Disney. It was quite clear more tan 20 years ago in the Rache Bartmoss' Guide to the Net!
The only way CB could do copy-write infringement on that image would be to copy it exactly without the artists okay. The can still do a three wheeled bike as big as that with a female figure.
If that were true then GW would have won instead of lost their court case years ago against (I don’t remember… Puppet Wars?). A company that did heads, weapons, and arms for Space Marines, Imperial Guard, and Orks, etc. If it were the case then CB wouldn’t have been able to make anything that looks even a little like Anime, Video Games, etc. sorry but those heavy infantry look too much like Halo/Appleseed/GiTS/etc, shut it down! I’m not saying they can just copy away, but the artists doesn’t have copywrite of three wheeled bikes with female riders! Also, the chances of any suit coming from such a small think is highly unlikely.
The company was called Chapterhouse Studios. Now they are called Pop Goes The Monkey and do lots of 3d printing. I'd just like to see less "homages" and recycling of boring poses, more originality, and less damned motorcycles in the game.
