All that was claimed was that if, at the moment you enter Engaged state, you are at moment also in (or still in) the mine-owner's declared template placement, then the template attack is invalid. It is up to the aleph player to not put the mine template down such that it can hit a nomad model at a point where that nomad model is engaged.
That whoopsie soldier painting reminded me more of Captain Mainwaring .. tache is too wide for the other.
